These Disclaimers and Limitation of Liability Terms (“Terms”) apply to all testing, biological interventions, care coordination, provider tools, clinical interpretation, and support services delivered through the BATWATCH™ platform.

We receive many requests from patients and families to see Dr. Silver House’, ‘Silver House’, or ‘Mr Brain Health’.

The term ‘Dr. Silver House’, ‘Silver House’, or ‘Mr Brain Health’, as it relates to Aspen Decker, our founder, CEO, and spokesperson, are honorary nicknames given by his brain health community and millions of social media followers.

Any reference to ‘Dr. Silver House’, ‘Silver House’, or ‘Mr Brain Health’, online should not be confused with Aspen practicing medicine. Aspen is not a doctor, nor does he claim to be doing so.

The nickname is inspired by the renowned TV character Dr. House, for Aspen’s unwavering commitment to brain health, his passionate pursuit of answers to impossible health-related questions, and his insatiable need to find ongoing care solutions for the underserved cognitively impaired older adult patient population.

Aspen may not a medical doctor, but his passion for innovative solutions and his deep empathy for his community has made him a respected figure in the field, offering hope and guidance to those in need.

Aspen cares deeply about anyone affected by cognitive impairment and is more than happy to provide guidance and support to those who are struggling and in need of hope and information, but he cannot be requested to treat anyone.

Additional Note on Usernames and Public Identity

As our community has grown, so has the way people refer to Aspen. While “Dr. Silver House” originated as a nickname from early followers who admired his investigative approach to health, over time he has also become known simply as Silver House… and more recently, MrBrainHealth.

All three names refer to him personally, and all are used in different public-facing contexts, depending on the audience and platform.

“Dr. Silver House” is a symbolic nickname… not a clinical title.

“Silver House” is the shorthand version widely used across platforms.

“MrBrainHealth” is his new official username and domain name, chosen for clarity, brand cohesion, and to reduce confusion for new audiences.

These names were either given to him by supporters or adopted to help expand access, build trust, and grow awareness around the mission. They’re not intended to mislead… they’re tools for communication and outreach.

No matter what name he goes by, the core truth remains:

He is not a medical doctor. He doesn’t treat patients directly.

BATWATCH™ for Patients

The term “BATWATCH™” refers to an integrated ecosystem of affiliated legal entities and digital coordination frameworks, including:

BATWatch Medical Group, LLC: A management services organization (MSO) that provides operational support, digital tools, and coordination protocols to assist licensed professionals in monitoring early brain health trends.

Affiliated Professional Corporations (PCs): State-licensed entities independently responsible for delivering healthcare services under applicable laws. These operate under their own clinical judgment while optionally leveraging BATWATCH™-branded tools.

BATWATCH™ Provider Network: A group of independent, licensed providers who may utilize BATWATCH™’s protocols, testing platforms, or analytics tools as part of their clinical decision-making. Participation is voluntary and governed by state-specific scope-of-practice requirements.

BATWatch, Inc.: The technology and intellectual property company that developed and licenses the BATWATCH™ platform. BATWatch, Inc. is not a clinical provider and does not engage in the practice of medicine.

Unless otherwise noted, references to “BATWATCH™” refer to this ecosystem functioning within each entity’s defined legal and operational scope.

1. General Disclaimers for the BATWATCH™ Program

a) Prevention-First Brain Health Platform
BATWATCH™ is a proactive brain health platform focused on identifying and responding to early biological signals that may be associated with long-term neurological risk. It incorporates biomarker trend tracking, longitudinal scoring, and science-informed frameworks to support earlier decision-making. Select elements of the program may include physician-guided, research-informed protocols involving the use of FDA-approved medications outside of their originally approved indications. These uses are determined solely by the discretion of licensed healthcare providers.

b) No Guarantees of Specific Outcomes
Participation in BATWATCH™ does not guarantee any particular result or health outcome. Individual responses vary based on a range of factors, including biological profile, adherence to guidance, and underlying health conditions. All data is presented for informational purposes only and may not predict personal outcomes.

c) Educational and Informational Use Only
All reports, summaries, dashboards, assessments, or other materials generated by the BATWATCH™ platform are intended for educational and informational use. Nothing provided by BATWATCH™ constitutes medical advice or is a substitute for clinical care. Users should always consult their licensed healthcare provider before making medical decisions.

d) Protocol Evolution and Scientific Updates
BATWATCH™ protocols and participation guidelines are subject to change as scientific evidence, regulatory guidance, and operational standards evolve. All updates are made in alignment with BATWATCH™’s internal evidence review policies and do not constitute a clinical standard of care.

e) Participation Terms and Eligibility
Access to specific components of the BATWATCH™ platform may vary over time and by jurisdiction. BATWATCH™ reserves the right to modify or discontinue services, features, or participation criteria based on legal, regulatory, clinical, or operational considerations.

f) Not for Diagnosis or Treatment of Alzheimer’s Disease
BATWATCH™ does not provide diagnosis, treatment, or cure for Alzheimer’s disease or any other neurological disorder. While certain biomarkers monitored through the platform may have relevance in research involving neurodegeneration, the program is designed for educational and early trend awareness purposes only. Any discussion of biomarkers such as Beta-Amyloid or Tau is not intended to imply clinical diagnosis, prediction, or prevention of any specific disease.

2. BAT PILL™ Protocol (BPP) Disclaimers:

a) Off-Label Use of Sirolimus (Rapamycin):
The BAT PILL™ Protocol (“BPP”) is a short-cycle, biomarker-informed framework intended to support proactive brain health strategies. It incorporates physician-guided use of Sirolimus (Rapamycin), an FDA-approved medication for other indications, applied here in a pulsed, off-label format. Off-label prescribing is a legally recognized practice when undertaken at the discretion of licensed providers.

b) Ethical and Evidence-Based Use:
The inclusion of Sirolimus in this protocol aligns with common ethical norms around off-label prescribing observed across fields such as oncology, cardiology, and longevity research. Its use is supported by published literature and mechanistic research exploring its effects on cellular cleanup processes (autophagy) and immune regulation. BATWATCH™ references this scientific landscape for educational purposes only and does not represent these findings as guarantees of clinical outcomes.

c) Research-Informed but Not Guaranteed:
The BPP is informed by decades of peer-reviewed science into autophagy and related biological mechanisms. However, outcomes vary significantly by individual, and no result is assured. The protocol should be understood as a proactive, physician-guided option, not as a guaranteed solution or standardized therapy.

d) Not a Treatment or Cure for Alzheimer’s Disease:
The BPP is not a treatment for Alzheimer’s disease or any other neurological condition. It does not claim to cure, halt, or reverse disease progression. It is designed solely as an educational and prevention-oriented framework to highlight early biological risk and support patient-provider discussions about proactive management.

e) Medication Risks and Side Effects:
As with all medications, Sirolimus carries potential risks, including but not limited to: mouth sores, elevated cholesterol, gastrointestinal upset, immune modulation, and, in rare cases, lung or skin sensitivity. These risks are reviewed with participants by licensed providers prior to initiation and monitored throughout the protocol.

3. BAT TESTING™ Protocol Disclaimers:
a) Purpose of Testing – Biological Risk Assessment:
BAT TESTING™ is a proactive screening framework designed to support educational awareness around early biological signals, including Beta-Amyloid (BA), Tau (T), and selected genetic risk markers. These insights are intended to help users understand general risk patterns and biological trends over time. BAT TESTING™ is not a diagnostic tool and is not intended to diagnose, treat, or confirm any medical condition, including Alzheimer’s disease.

b) Accuracy and Interpretation Limitations:
BAT TESTING™ uses established biomarker methods and third-party laboratory analysis to evaluate biological markers. However, all biomarker testing is subject to variability based on timing, biological state, lab conditions, and external factors such as inflammation, sleep, or stress. Results may shift over time and should always be interpreted in clinical context by a qualified provider. No test result should be used in isolation to guide medical decisions.

c) Laboratory Partners and Quality Control:
BAT TESTING™ is facilitated through independent, certified laboratory partners that meet national quality standards. BATWATCH™ coordinates test logistics and quality procedures but does not control or warrant the actions, timelines, or analytic procedures of third-party labs. Delays, technical errors, or result variability introduced during external handling are outside of BATWATCH™’s operational control.

d) Complementary Role – Not a Replacement for Medical Workup:
BAT TESTING™ is intended as an educational and preventative tool for monitoring general biological drift over time. It is not a replacement for formal neurological evaluation or medical consultation. If symptoms are present or progressing, users should seek direct clinical care. BAT TESTING™ is best used to support longer-term awareness and risk stratification, not to substitute for diagnostic pathways when clinical concerns arise.

4. Telehealth Services Disclaimers:

a) Scope of Telehealth Support
Telehealth services offered through the BATWATCH™ program include virtual visits focused on interpreting lab data, supporting prevention-oriented planning, and guiding biomarker monitoring. These services are intended to complement, not replace, your existing relationship with an in-person primary care provider or specialist.

b) Technology Limitations
BATWATCH™ utilizes secure internet-based platforms to enable virtual care. As with any digital service, disruptions may occur due to connectivity issues, system maintenance, or third-party platform outages. BATWATCH™ cannot guarantee uninterrupted service and is not liable for technical interruptions beyond our control.

c) Medical Records and Privacy Compliance
All telehealth interactions are documented and securely maintained in accordance with HIPAA and applicable state privacy regulations. Patients’ health data is safeguarded using industry-compliant protocols and confidentiality standards.

d) Data Security and Platform Use
BATWATCH™ platforms are HIPAA-compliant and employ standard encryption and access safeguards. However, all internet-based systems carry inherent security risks. By using BATWATCH™ telehealth services, you acknowledge and accept the limitations of third-party software and external platforms beyond BATWATCH™’s direct control.

e) Clinical Limitations of Virtual Care
Virtual visits are effective for lab interpretation and general brain health planning. They are not a substitute for in-person exams when physical evaluation or imaging is required. When appropriate, BATWATCH™ clinicians may recommend in-person follow-up or refer patients to additional care.

5. BATWatch™ Study Data Disclaimers

a) Internal Observational Research Model
The BATWATCH™ Protocol is informed by ongoing internal, non-randomized observational studies that monitor biological trends, including Beta-Amyloid 42/40 ratios and pTau 181 levels, in users participating in short-cycle intervention protocols. These studies are conducted solely for internal quality improvement, protocol refinement, and educational awareness. The insights derived are not intended to imply diagnostic validity, therapeutic claims, or guaranteed outcomes for individual users.

b) Important Considerations
i) The BATWATCH™ Protocol is a prevention-first, biomarker-monitoring framework, not a treatment for Alzheimer’s disease or any specific neurological diagnosis. It focuses on identifying early biological drift and modifiable risk indicators, supporting timely action before symptom onset.

ii) This study framework is dynamic and evolving. Data insights may shift as more participants complete testing cycles and longer-term trends are reviewed. All findings should be interpreted within the context of exploratory, observational research.

iii) Biological responses are highly individualized. While some users may exhibit reductions in Beta-Amyloid or pTau levels, these changes do not ensure disease avoidance or predict specific clinical trajectories.

vi) While our overarching aim is to delay or reduce future brain health risks, the core purpose of this research is to detect and respond to early biological signals that might otherwise go unnoticed. Preliminary longitudinal data supports the potential of this model in surfacing actionable trends earlier in the biological trajectory, but clinical conclusions should be deferred to licensed healthcare professionals.

6. General Risk Acknowledgments

a) Voluntary Participation
Participation in the BATWATCH™ Program, including BAT TESTING™, the BAT PILL™ Protocol (BPP), and telehealth services, is entirely voluntary. By enrolling, you confirm that you have reviewed the relevant program materials, understand the nature and scope of the offerings, and have provided informed consent to proceed.

b) No Guarantee of Insurance Coverage
Coverage for BATWATCH™ services depends on your specific insurance plan and may vary by provider, service type, and state. BATWATCH™ makes no guarantees regarding insurance reimbursement. You remain financially responsible for any costs not covered by insurance, in accordance with our Patient Financial Terms.

c) Program Scope and Limitations
BATWATCH™ is a specialized brain health platform focused on early biological risk tracking and prevention-oriented strategies. It does not replace comprehensive medical care, in-person examinations, or specialty consultations. Regular engagement with your primary care provider is strongly recommended to ensure whole-health continuity.

d) Not an Emergency Service
BATWATCH™ is not equipped to handle medical emergencies or acute care needs. In the event of a medical emergency, call 911 or visit the nearest emergency facility immediately.

7. General Medical Risk and Research Acknowledgment

a) Evolving Science and Protocols
You acknowledge that BATWATCH™ is rooted in ongoing, evolving scientific research. Testing strategies, educational content, and intervention protocols may change over time in response to new findings. These updates are made in accordance with BATWATCH™’s Research & Reference Policy.

b) No Guaranteed Elimination of Risk
BATWATCH™ is designed to identify and address early biological signals associated with long-term brain health risk. However, no intervention or monitoring system can guarantee risk elimination or prevent future medical conditions. Results vary based on individual biology, adherence, and external factors.

c) Optional Research Participation
Formal research components (when offered) are entirely optional and governed by separate informed consent processes. Participation in research may contribute to the development of future protocols but is not expected to deliver personal medical benefit.

d) Use of De-Identified Data
You consent to the use of your de-identified health data for internal research, analytics, and potential publication of aggregate results. All data use complies with HIPAA, relevant data privacy laws, and BATWATCH™’s HIPAA Notice of Privacy Practices. No identifiable information is shared without express authorization.

8. Limitation of Liability
To the fullest extent permitted by law:

a) No Warranty:
The BATWATCH™ Program, including all testing, telehealth services, the BAT PILL™ Protocol, and digital tools.. is offered on an “as-is” and “as-available” basis. BATWATCH™ makes no warranties, express or implied, regarding outcomes, performance, or the completeness of information provided.

b) No Liability for Indirect Damages:
BATWATCH™ is not liable for any indirect, incidental, special, consequential, or punitive damage… including but not limited to loss of data, business interruption, goodwill, or potential earnings… arising from your participation in the program.

c) Cap on Liability:
If a claim is brought in connection with your participation in BATWATCH™, BATWATCH™’s total liability shall not exceed the total amount you paid for program services in the twelve (12) months immediately prior to the date the claim arose.

d) Third-Party Provider Limitations:
BATWATCH™ works with trusted third-party laboratories, telehealth systems, and infrastructure vendors to deliver services. BATWATCH™ is not liable for any errors, delays, or service failures caused by these external parties.

e) Force Majeure:
BATWATCH™ is not responsible for delays or disruptions caused by events beyond our reasonable control, including but not limited to natural disasters, pandemics, internet outages, third-party shutdowns, government actions, or supply chain disruptions.

f) Non-Medical Consequences:
BATWATCH™ assumes no responsibility for non-medical effects of participation in the program. This includes, but is not limited to, psychological discomfort, impacts on employment status, or changes in insurance eligibility or underwriting.

g) Service and Lab Processing Delays:
Occasional delays in lab result turnaround, insurance processing, or telehealth scheduling may occur. BATWATCH™ is not responsible for such delays when caused by external labs, system partners, or regulatory actions.

By participating in the BATWATCH™ Program, you acknowledge that this is an innovative, prevention-oriented platform designed to monitor early biological patterns associated with brain health over time. It is grounded in emerging clinical science and uses proactive tools to help track biological drift before functional changes occur.

9. Acknowledgment of Understanding

a) Purpose of the Protocol
The BATWATCH™ Program includes access to a short-term, biomarker-guided protocol known as the BAT PILL™ Protocol (BPP). This protocol leverages pulsed, short-cycle use of Sirolimus (Rapamycin), an FDA-approved medication for unrelated conditions, aimed at supporting early biological clearance and stabilization of select biomarkers such as Beta-Amyloid (BA) and phosphorylated Tau (pTau), which may contribute to long-term neurological risk.

b) Off-Label Use Disclosure
Sirolimus is used off-label in the BPP. Off-label prescribing is an established, lawful practice in medicine when supported by scientific rationale and applied under proper clinical supervision. It is commonly used in specialties such as oncology, cardiology, and preventive medicine. In this protocol, its use is grounded in peer-reviewed literature and expert-guided implementation.

c) Evidence-Informed but Not Predictive
The BPP draws from research related to autophagy activation, inflammation regulation, and neuroprotective mechanisms. However, outcomes are not guaranteed, and individual biological responses may vary. The BPP is not a cure, treatment, or preventive guarantee for any medical condition.

d) Not a Diagnostic or Therapeutic Tool for Alzheimer’s Disease
Although the biomarkers monitored in BATWATCH™ may be associated with long-term neurological risk, participation in the program does not diagnose or treat Alzheimer’s disease or any other medical condition. The goal is to enable early biological awareness and support lifestyle or protocol-based prevention, not to serve as a replacement for clinical diagnostic services or disease management.

10. Release of Liability Specific to the BATWatch™ Program

By participating in the BATWATCH™ Program, including but not limited to the BAT TESTING™ workflow, the BAT PILL™ Protocol (BPP), and any telehealth coordination services, you acknowledge and agree to release BATWATCH™, its affiliated legal entities, providers, and administrative personnel from any liability related to your participation, to the maximum extent allowed by applicable law.

This general release applies to all aspects of your engagement and includes (but is not limited to) any claims arising from:

a) Biological Variability: Differences in individual response, biomarker trends, or physiological changes that may occur during or after participation.

b) Health History or Comorbidities: Any pre-existing or undiagnosed health conditions that may influence results, safety, or perceived effectiveness of any protocol component.

c) Prior Medical or Treatment Interactions: Residual effects from past medications, treatments, or health interventions that may affect biological outcomes or tolerance to the protocol.

d) Participation Adherence: Any variations in outcome due to incomplete protocol adherence, missed labs, inconsistent engagement, or deviation from provided instructions.

e) Underlying Medical Complexity: Challenges associated with managing or interpreting biological data in individuals with complex or rare medical conditions beyond the program’s scope.

f) Interaction with Other Conditions: Any influence the protocol may have on other ongoing or unrelated health issues, including unforeseen symptom shifts.

g) Unexpected Developments: Any unanticipated physical or medical changes arising independently of protocol participation, or that occur despite precautionary measures.

h) Emotional and Cognitive Responses: Any discomfort, stress, or emotional impact resulting from participation, biomarker awareness, or protocol-related decision-making.

i) Medication Reactions: Adverse responses, allergic events, or drug-specific side effects associated with off-label Sirolimus (Rapamycin) or other components of the BPP.

j) Temporary Disruption: Minor or transient discomfort, inconvenience, or adjustment effects during the initial protocol period or transition into program routines.

k) Family or Social Impact: Any personal, relationship, or household strain resulting from protocol engagement, changes in health routines, or learning of new biomarker information.

l) Other Unintended Outcomes: Any other direct or indirect consequence of participation not specifically foreseeable at the time of enrollment.

11. Indemnification

Indemnification terms for your participation in the BATWATCH™ Program are outlined in the BATWATCH™ Terms of Service, which you agree to by participating in this program. Please refer to the Indemnification Section of the BATWATCH™ Terms for complete details.

12. Governing Law and Dispute Resolution

Disputes arising from your participation in the BATWATCH™ Program, including any services under the BAT PILL™ Protocol (BPP), BAT TESTING™, or Telehealth Services, are subject to the dispute resolution and arbitration provisions outlined in the Dispute Resolution and Arbitration Terms.

Reference to Arbitration Terms: By participating in the BATWATCH™ Program, you acknowledge and agree that all disputes will be resolved according to the procedures specified in the Dispute Resolution and Arbitration Terms, including any binding arbitration provisions.

Priority of Terms: In the event of a conflict between this document and the Dispute Resolution and Arbitration Terms, the terms outlined in the Dispute Resolution and Arbitration Terms will govern for all dispute-related matters

13. Severability

If any provision of this document is found to be unenforceable by a court of law, the remaining provisions will remain in full force and effect.

14. No Waiver

Failure by BATWATCH™ to enforce any provision of this document does not constitute a waiver of that provision or any other provision.

15. Affirmative Consent to Disclaimers and Limitation of Liability:

By enrolling in the BATWATCH™ Program, you affirmatively agree to all disclaimers, acknowledgments, limitations of liability, and risk disclosures outlined in this document. You further understand that these disclaimers form a material part of your agreement with BATWATCH™. Additionally, you confirm that you have had the opportunity to ask questions, consult with your healthcare provider, and receive satisfactory answers before participating.

BATWATCH™ for Providers

1. Tools and Technology

a) Purpose of Tools
BATWATCH™ provides a suite of secure, HIPAA-compliant digital tools, including dashboards, coordination trackers, lab automation systems, and clinical workflows, to streamline patient management under the BATWATCH™ protocol. These tools are designed to reduce administrative burden and standardize coordination efforts. They are not a substitute for independent clinical judgment, nor do they constitute medical advice or supervision.

b) Technology and System Limitations
BATWATCH™ tools may rely on external platforms and vendors. As such, occasional service interruptions, syncing delays, or technical errors may occur. BATWATCH™ is not liable for service disruptions, data loss, or performance issues stemming from third-party tools or internet-based delivery systems.

c) Security and Privacy Responsibility
Providers are individually responsible for securing their login credentials, maintaining appropriate device security, and ensuring compliance with all applicable laws when handling patient-identifiable information accessed through BATWATCH™ platforms. Unauthorized access, use, or sharing of system content may result in immediate removal from the Provider Network and reporting to relevant authorities.

d) No Warranty or Clinical Guarantee
BATWATCH™ makes no warranty, express or implied, regarding the functionality, uptime, accuracy, or clinical utility of any provider-facing tool. All clinical decisions, including lab interpretation and treatment planning, remain the sole responsibility of the licensed provider. Participation in the Provider Network does not establish any employment, supervisory, or joint venture relationship.

2. Provider Compensation, Claims, and Credentialing

a) If Using BATWATCH™ for Claims Submission
Providers who opt into centralized billing agree to the following:

Claims may be delayed or denied until individual or group credentialing is completed with applicable payers. Timelines vary by payer and state.

BATWATCH™ will submit, track, and appeal claims on your behalf using your NPI or the group NPI once credentialed.

BATWATCH™ does not guarantee reimbursement. Providers remain responsible for timely document responses, audit support, and payer credentialing compliance.

Prior to full credentialing, you may be compensated directly by payers. Upon activation of group workflows, compensation will be processed according to the selected model.

b) If Submitting Claims Independently
If you choose to bill independently:

You accept full responsibility for submission, appeals, and tracking of your claims.

BATWATCH™ will provide visit summaries and documentation when available, but does not assume liability for any revenue cycle outcomes.

Participation does not guarantee patient volume, minimum earnings, or payer approval. All compensation is performance-based and contingent on payer policies and eligibility criteria.

3. Provider Participation, Availability, and Referrals

a) Onboarding, Telehealth, and Training Expectations
BATWATCH™ offers structured onboarding, shadowing, and asynchronous training to support clinical readiness. These sessions are optional but strongly encouraged to ensure alignment with protocol expectations and platform use.

Missed onboarding steps or repeated non-responsiveness may limit access to referrals or result in de-prioritization.

BATWATCH™ is not responsible for enforcing provider training completion.

b) Referral Assignment
Referrals are routed based on state licensure, availability, credentialing status, prior engagement, and platform responsiveness.

You acknowledge that:

Referral volume is not guaranteed.

Assignment priority is dynamic and based on participation, response times, and ongoing clinical activity.

Providers who fail to engage in lab reviews, telehealth visits, or protocol coordination may be temporarily paused or removed from active routing.

c) Independent Provider Status
All BATWATCH™ providers operate as independent contractors or professionals. No employment relationship is created through participation. Providers are solely responsible for:

Maintaining active licensure

Carrying appropriate malpractice insurance

Ensuring ongoing participation and clinical availability

d) Provider Communication and Continuity
BATWATCH™ is not liable for missed patient follow-up, dissatisfaction, or clinical delays due to a provider’s lack of response, scheduling challenges, or disengagement. If a provider fails to engage in a timely manner, patients may be reassigned without notice.
