These Disclaimers and Limitation of Liability Terms (“Terms”) apply to all testing, biological interventions, care coordination, provider tools, clinical interpretation, and support services delivered through the BATWatch™ platform.

We receive many requests from patients and families to see Dr. Silver House’, ‘Silver House’, or ‘Mr Brain Health’.

The term ‘Dr. Silver House’, ‘Silver House’, or ‘Mr Brain Health’, as it relates to Aspen Decker, our founder, CEO, and spokesperson, are honorary nicknames given by his brain health community and millions of social media followers.

Any reference to ‘Dr. Silver House’, ‘Silver House’, or ‘Mr Brain Health’, online should not be confused with Aspen practicing medicine. Aspen is not a doctor, nor does he claim to be doing so.

The nickname is inspired by the renowned TV character Dr. House, for Aspen’s unwavering commitment to brain health, his passionate pursuit of answers to impossible health-related questions, and his insatiable need to find ongoing care solutions for the underserved cognitively impaired older adult patient population.

Aspen may not a medical doctor, but his passion for innovative solutions and his deep empathy for his community has made him a respected figure in the field, offering hope and guidance to those in need.

Aspen cares deeply about anyone affected by cognitive impairment and is more than happy to provide guidance and support to those who are struggling and in need of hope and information, but he cannot be requested to treat anyone.

Additional Note on Usernames and Public Identity

As our community has grown, so has the way people refer to Aspen. While “Dr. Silver House” originated as a nickname from early followers who admired his investigative approach to health, over time he has also become known simply as Silver House… and more recently, MrBrainHealth.

All three names refer to him personally, and all are used in different public-facing contexts, depending on the audience and platform.

“Dr. Silver House” is a symbolic nickname… not a clinical title.

“Silver House” is the shorthand version widely used across platforms.

“MrBrainHealth” is his new official username and domain name, chosen for clarity, brand cohesion, and to reduce confusion for new audiences.

These names were either given to him by supporters or adopted to help expand access, build trust, and grow awareness around the mission. They’re not intended to mislead… they’re tools for communication and outreach.

No matter what name he goes by, the core truth remains:

He is not a medical doctor. He doesn’t treat patients directly.

He operates with transparency, integrity, and a relentless drive to give people earlier access to meaningful brain health information.

BATWatch™ for Patients

The term “BATWatch” refers collectively to a network of affiliated legal entities and coordination systems, including:

BATWatch Medical Group, LLC – A national management services organization (MSO) that provides infrastructure, coordination protocols, digital tools, and operational oversight to support early brain health monitoring and intervention.

Affiliated Professional Corporations (PCs) – State-licensed entities operating under the BATWatch name (e.g., BATWatch of California, PC) responsible for delivering clinical services and telehealth care, where licensed.

BATWatch Provider Network – Licensed, independent providers who engage in testing, biological review, or care coordination under the BATWatch protocol.

Silver House Technologies, Inc. – The parent company and intellectual property owner that created and licenses the BATWatch platform, scoring systems, and drift-tracking frameworks. Silver House does not deliver clinical services or act as a healthcare provider.

Unless otherwise noted, references to “BATWatch” in this document refer collectively to the ecosystem above, functioning within each entity’s defined legal and operational scope.

1. General Disclaimers for the BATWatch™ Program

a) Prevention-First Brain Health Platform:
BATWatch is a proactive brain health program designed to identify and respond to early biological changes that may contribute to long-term neurological risk. It leverages biomarker testing, longitudinal tracking, and science-backed protocols to support earlier, data-driven decision-making. Some components of the program may incorporate research-based, off-label, or experimental use of FDA-approved medications to assist in short-term biological reset cycles.

b) No Guarantees of Specific Outcomes:
Participation in BATWatch is not a guarantee of any specific medical result or long-term outcome. Biological responses may vary based on individual history, biological drift patterns, and adherence to recommendations.

c) For Educational Purposes Only:
Any content, testing summaries, or communication from BATWatch, including platform dashboards, reports, or assessments, is intended for educational and informational purposes only. It is not intended to replace the advice or judgment of your personal healthcare provider.

d) Evolving Protocols:
The BATWatch program integrates ongoing research, updated scientific findings, and shifting regulatory standards. As such, protocols and participation criteria may evolve. BATWatch reserves the right to update services and processes in accordance with clinical evidence and best practices.

e) Participation and Eligibility Adjustments:
Eligibility or access to certain program components may change over time as protocols adapt. BATWatch may modify or discontinue services or participation if deemed necessary by clinical, operational, or compliance updates.

f) Not a Diagnosis or Guarantee Against Alzheimer’s Disease:
BATWatch is not an Alzheimer’s diagnosis tool, nor is it a guarantee of prevention. While the program is designed to detect and monitor biological signals associated with long-term neurological risk, including Beta-Amyloid and Tau, participation does not confirm, prevent, or treat any specific condition such as Alzheimer’s disease. The goal is early biological awareness and risk reduction, not diagnosis or disease management.

2. BAT Pill Protocol (BPP) Disclaimers:

a) Off-Label Use of Sirolimus (Rapamycin):
The BAT Pill Protocol (“BPP”) is a short-term, biomarker-driven intervention designed to support brain health by reducing Beta-Amyloid and slowing biological drift. The protocol uses Sirolimus (Rapamycin), an FDA-approved medication for other conditions, applied here in a pulsed, off-label format. Off-label prescribing is a standard, medically recognized practice when guided by scientific evidence and clinical judgment.

b) Ethical and Evidence-Based Use:
The off-label use of Sirolimus in this protocol aligns with ethical prescribing norms seen across many specialties, including oncology, cardiology, and longevity medicine. Its inclusion is based on published research, real-world case studies, and a growing body of data supporting its mechanism of action in cellular cleanup (autophagy) and inflammation regulation.

c) Research-Informed but Not Guaranteed:
The BPP is grounded in decades of scientific investigation, including studies linking autophagy activation and Beta-Amyloid reduction to brain health outcomes. However, as with any biological intervention, individual results may vary, and no outcome can be promised. This is a proactive tool, not a guaranteed solution.

d) Not a Treatment or Cure for Alzheimer’s Disease:
The BPP is not a treatment for Alzheimer’s disease or any other diagnosis. It is not intended to cure, halt, or reverse neurological decline. It is used solely to support early risk reduction and biological clearance in patients with confirmed biomarker elevation. The development of conditions like Alzheimer’s is influenced by multiple factors beyond the scope of this protocol.

e) Medication Risks and Side Effects:
As with any medication, Sirolimus carries potential risks, which may include mouth sores, elevated cholesterol, digestive upset, immune modulation, or in rare cases, lung or skin sensitivity. These risks are reviewed in detail prior to participation and are monitored closely throughout the protocol.

3. BAT Testing Protocol Disclaimers:
a) Purpose of Testing – Biological Risk Assessment:
BAT Testing is a proactive brain health screening tool that evaluates early biological signals, including Beta-Amyloid (BA), Tau (T), and related genetic markers. These results are intended to help detect biological drift and assess long-term risk factors. They are not diagnostic of any disease, and specifically do not diagnose Alzheimer’s or any other condition.

b) Accuracy and Interpretation Limitations:
BAT Testing utilizes validated assays and evidence-based methods to evaluate biomarker levels. However, no test is infallible. Results may be influenced by biological variability, lab handling, or transient factors such as sleep, stress, or inflammation. Occasional false positives or negatives are possible. Results should always be reviewed in clinical context and not used in isolation.

c) Laboratory Partners and Quality Control:
Testing is conducted through certified third-party labs that meet national standards for biomarker analysis. While BATWatch coordinates testing and quality control efforts, we are not liable for delays, technical issues, or procedural variability introduced by external laboratory partners.

d) Complementary Role – Not a Replacement for Medical Workup:
BAT Testing is a preventive tool for identifying early biological signals… not a substitute for full neurological evaluation. If clinical symptoms are present, comprehensive assessments (e.g., imaging, neurological consultation) should still be pursued. BAT Testing is designed to support long-term monitoring and prevention… not to replace formal diagnostic protocols when symptoms arise.

4. Telehealth Services Disclaimers:
a) Scope of Telehealth Support:
Telehealth services offered through the BATWatch Program include virtual visits for lab interpretation, prevention-focused planning, and ongoing monitoring of brain health metrics. These services are designed to complement… not replace… your relationship with an in-person primary care provider or specialist.

b) Technology Limitations:
BATWatch uses secure, internet-based platforms to deliver telehealth care. Like any digital service, occasional disruptions may occur due to connectivity issues, platform maintenance, or third-party system outages. While we strive to ensure reliable service, BATWatch is not responsible for interruptions caused by external technical issues.

c) Medical Records and Privacy Compliance:
All telehealth consultations are documented and securely stored in your BATWatch medical record. We comply with HIPAA and applicable state laws to ensure patient confidentiality and privacy.

d) Data Security and Platform Use:
BATWatch uses HIPAA-compliant systems and industry-standard safeguards to protect your data. However, as with any internet-based platform, absolute security cannot be guaranteed. By participating in telehealth services, you acknowledge that third-party tools may carry inherent data risks beyond BATWatch’s control.

e) Clinical Limitations of Virtual Care:
Telehealth visits are effective for interpreting lab results and coordinating next steps, but they are not a full substitute for in-person care when physical examination or imaging is needed. If a clinical concern falls outside the scope of virtual care, we will refer you to appropriate in-person follow-up.

5. BATWatch Study Data Disclaimers:
The BATWatch Protocol is part of an ongoing, rolling observational real-world evidence study tracking biological drift in Beta-Amyloid (BA) 42/40 ratios and phosphorylated Tau (pTau 181) levels in patients participating in short-term BAT Pill cycles. These biomarkers are used to assess internal clearance performance and inform brain health risk stratification over time.

As of the most recent analysis (n=600), observed outcomes include:

a) Up to 87% of patients demonstrated measurable reductions in Beta-Amyloid (BA) 42/40 ratios after completing at least one BAT Pill cycle.

b) Up to 74% of patients showed a measurable decrease in pTau 181, with reductions varying based on baseline Tau levels.

c) Beta-Amyloid reductions typically ranged from 10–30% per cycle, with some patients requiring multiple cycles to reach the stability threshold of ≥0.150.

d) pTau 181 response rates varied by baseline biological profile:

Lower baseline Tau: 60–74% reduction per cycle

Moderate baseline Tau: 5–20% reduction per cycle

Higher baseline Tau: Limited response observed

e) Important Considerations:

i) The BATWatch Protocol is a prevention-first approach… not a treatment for Alzheimer’s or any specific neurological disease. The focus is on addressing early biological drift and modifiable risk factors through targeted support and real-time monitoring.

ii) This is an ongoing research model. Data will continue to evolve as additional patients complete post-cycle testing and longer-term outcomes are assessed.

iii) Individual responses vary. Reductions in Beta-Amyloid or Tau biomarkers do not guarantee prevention of neurological decline. These markers are tools for tracking risk… not predictors of disease certainty.

iv) Results are based on internal observational data and supported by published scientific research, as referenced in our Research Library. This study is conducted in alignment with evolving scientific standards for early risk monitoring.

v) The BATWatch study is not registered or regulated as an FDA-approved clinical trial. It is an observational, protocol-driven research program and should be interpreted within the scope of preventive brain health… not disease treatment.

vi) While our goal is to delay or reduce long-term brain health risk, the primary purpose of this work is to detect and respond to early signals that would otherwise go unnoticed. Ongoing longitudinal data continues to reinforce the potential impact of this model for proactive risk reduction—before damage sets in.

6. General Risk Acknowledgments:

a) Voluntary Participation:
Participation in the BATWatch Program, including BAT Testing, the BAT Pill Protocol (BPP), and any telehealth services… is entirely voluntary. By enrolling, you acknowledge that you have reviewed the relevant program materials, understand the potential benefits and limitations, and have provided informed consent to proceed.

b) No Guarantee of Insurance Coverage:
While many components of the BATWatch Program may be covered under preventive health provisions, coverage is determined by your individual insurance plan. BATWatch does not guarantee reimbursement for services rendered. You remain responsible for any out-of-pocket costs as outlined in the Patient Financial Terms.

c) Program Scope and Limitations:
BATWatch is a specialized platform focused on brain health monitoring, early biological risk detection, and preventive support. It does not replace comprehensive primary care, in-person clinical evaluations, or specialty services related to other medical conditions. Ongoing engagement with your primary care provider is strongly encouraged.

d) Not a Source of Emergency Care:
BATWatch does not provide emergency medical services. If you are experiencing a medical emergency or require urgent care, call 911 or proceed to the nearest emergency facility immediately.

7. General Medical Risk and Research Acknowledgment:

a) Evolving Science and Protocols:
You acknowledge that the BATWatch Program is grounded in emerging scientific research. As new findings become available, testing strategies, recommendations, and intervention options may evolve to reflect the latest evidence in brain health monitoring and biological risk management.

b) No Guaranteed Risk Elimination:
Participation in the BATWatch Program, including BAT Testing, the BAT Pill Protocol, or lifestyle recommendations… may help reduce biological signals associated with long-term brain health risk. However, no protocol can guarantee the prevention or elimination of future neurological concerns. Individual outcomes may vary.

c) Optional Research Participation:
If you choose to participate in formal research studies associated with BATWatch, you understand that participation is voluntary and carries inherent uncertainties. Study outcomes cannot be predicted, and you may or may not experience any direct benefit from participation.

d) Use of De-Identified Health Data:
You consent to the use of your de-identified health information for internal research, quality improvement, and potential publication of aggregate findings. All data is handled in accordance with the BATWatch HIPAA Notice of Privacy Practices and applicable data protection laws.

8. Limitation of Liability
To the fullest extent permitted by law:

a) No Warranty:
The BATWatch Program, including all testing, telehealth services, the BAT Pill Protocol, and digital tools.. is offered on an “as-is” and “as-available” basis. BATWatch makes no warranties, express or implied, regarding outcomes, performance, or the completeness of information provided.

b) No Liability for Indirect Damages:
BATWatch is not liable for any indirect, incidental, special, consequential, or punitive damage… including but not limited to loss of data, business interruption, goodwill, or potential earnings… arising from your participation in the program.

c) Cap on Liability:
If a claim is brought in connection with your participation in BATWatch, BATWatch’s total liability shall not exceed the total amount you paid for program services in the twelve (12) months immediately prior to the date the claim arose.

d) Third-Party Provider Limitations:
BATWatch works with trusted third-party laboratories, telehealth systems, and infrastructure vendors to deliver services. BATWatch is not liable for any errors, delays, or service failures caused by these external parties.

e) Force Majeure:
BATWatch is not responsible for delays or disruptions caused by events beyond our reasonable control, including but not limited to natural disasters, pandemics, internet outages, third-party shutdowns, government actions, or supply chain disruptions.

f) Non-Medical Consequences:
BATWatch assumes no responsibility for non-medical effects of participation in the program. This includes, but is not limited to, psychological discomfort, impacts on employment status, or changes in insurance eligibility or underwriting.

g) Service and Lab Processing Delays:
Occasional delays in lab result turnaround, insurance processing, or telehealth scheduling may occur. BATWatch is not responsible for such delays when caused by external labs, system partners, or regulatory actions.

9. Acknowledgment of Understanding
By participating in the BATWatch Program, you acknowledge that this is an innovative, prevention-focused platform for monitoring and supporting long-term brain health. It is built on evolving clinical research and designed to help individuals track biological drift and take early action—before decline occurs.

You understand and agree that:

a) Purpose of the Protocol:
The BATWatch Program includes the option to participate in a short-term, off-label intervention known as the BAT Pill Protocol (BPP), which is intended to support the reduction of elevated Beta-Amyloid and Tau levels—key markers of biological accumulation in the brain. The BPP uses Sirolimus (Rapamycin), an FDA-approved medication for other conditions, delivered in short, pulsed cycles to help reset internal clearance systems.

b) Off-Label Use Disclosure:
The use of Sirolimus in this protocol is off-label, a standard and legally recognized practice in medicine. Off-label prescribing is supported in many fields—such as oncology, cardiology, and longevity care—when grounded in scientific evidence, and when applied transparently and ethically to support patient safety.

c) Research-Based and Evidence-Informed:
The BPP is based on a body of peer-reviewed research, clinical experience, and established principles of autophagy activation, neurobiological regulation, and systems-based intervention. While early results are promising, the protocol is not a cure or guaranteed method for preventing any specific disease. Biological responses vary, and outcomes cannot be predicted with certainty.

d) Not a Treatment or Cure for Alzheimer’s Disease:
Although elevated BAT Levels are associated with increased risk of Alzheimer’s and other neurological conditions, the BATWatch Protocol is not a treatment or cure for any disease. Its purpose is to identify early biological signals and provide evidence-based strategies for managing those risks.

By continuing with the program, you also confirm that you have reviewed, understood, and agreed to the terms outlined in the following program documents, which together constitute the full agreement governing your participation:

10. Release of Liability Specific to the BATWatch™ Program

By participating in the BATWatch Program, including any component of the BAT Testing workflow, the BAT Pill Protocol, or telehealth coordination services, you agree to release BATWatch, its affiliated entities, providers, and administrative team from any liability associated with the outcomes of your participation, to the fullest extent permitted by law.

This release includes, but is not limited to, any claims arising from:

a) Individual Variability – Differences in biological response, degree of biomarker change, or unexpected physiological reactions.

b) Health History – The presence of pre-existing conditions, comorbidities, or previously undiagnosed issues that may influence program outcomes or interactions.

c) Past Medical and Treatment History – Any prior medications, therapies, or health events that may affect how your body responds to the current protocol.

d) Adherence and Participation – Differences in outcome due to variations in your compliance with lab schedules, protocol instructions, or follow-up monitoring.

e) Complex or Rare Conditions – Outcomes affected by individual health complexities that may not be fully addressed by the protocol’s scope.

f) Interactions with Pre-Existing Conditions – Aggravation of, or unanticipated interactions with, other ongoing health issues.

g) Unexpected Medical Events – Sudden or unanticipated health developments not foreseeable at the time of enrollment.

h) Emotional or Psychological Effects – Any stress, discomfort, anxiety, or emotional response resulting from participation, interpretation of results, or decision-making based on protocol recommendations.

i) Medication Reactions – Allergic, adverse, or unexpected responses to any medications used during the BAT Pill Protocol, including Sirolimus (Rapamycin).

j) Adjustment Period – Temporary discomfort, physiological reactions, or lifestyle disruption that may occur during the first phase of participation or protocol initiation.

k) Relationship or Emotional Strain – Changes in interpersonal dynamics, family stress, or psychological tension arising from protocol engagement or health discoveries.

l) Unintended or Unforeseen Consequences – Any other unexpected outcomes, physical or emotional, related directly or indirectly to the use of BATWatch services.

You further acknowledge and accept that this Release of Liability applies regardless of any claims of ordinary negligence or perceived fault on the part of BATWatch, its representatives, or affiliated entities… except where prohibited by applicable law.

11. Indemnification

Indemnification terms for your participation in the BATWatch Program are outlined in the BATWatch Terms of Service, which you agree to by participating in this program. Please refer to the Indemnification Section of the BATWatch Terms for complete details.

12. Governing Law and Dispute Resolution

Disputes arising from your participation in the BATWatch Program, including any services under the BAT Pill Protocol (BPP), BAT Testing, or Telehealth Services, are subject to the dispute resolution and arbitration provisions outlined in the Dispute Resolution and Arbitration Terms.

Reference to Arbitration Terms: By participating in the BATWatch Program, you acknowledge and agree that all disputes will be resolved according to the procedures specified in the Dispute Resolution and Arbitration Terms, including any binding arbitration provisions.

Priority of Terms: In the event of a conflict between this document and the Dispute Resolution and Arbitration Terms, the terms outlined in the Dispute Resolution and Arbitration Terms will govern for all dispute-related matters

13. Severability

If any provision of this document is found to be unenforceable by a court of law, the remaining provisions will remain in full force and effect.

14. No Waiver

Failure by BATWatch to enforce any provision of this document does not constitute a waiver of that provision or any other provision.

15. Affirmative Consent to Disclaimers and Limitation of Liability:

By enrolling in the BATWatch Program, you affirmatively agree to all disclaimers, acknowledgments, limitations of liability, and risk disclosures outlined in this document. You further understand that these disclaimers form a material part of your agreement with BATWatch. Additionally, you confirm that you have had the opportunity to ask questions, consult with your healthcare provider, and receive satisfactory answers before participating.

BATWatch for Providers

1.Tools and Tech

a) Purpose of Tools
BATWatch provides a suite of secure, HIPAA-compliant tools, including digital dashboards, coordination trackers, lab automation systems, and clinical workflows, to facilitate streamlined patient management under the BATWatch protocol. These tools are intended to reduce administrative burden and standardize care, and are not a substitute for your independent clinical judgment.

b) Technology and System Limiatations
BATWatch tools may rely on third-party platforms and may experience service interruptions, syncing delays, or bugs. While we work to ensure platform stability, we cannot guarantee uninterrupted access and assume no liability for issues beyond our control.

c) Security and Privacy Responsibility
Providers are responsible for protecting login credentials, device security, and appropriate use of any patient-identifiable data accessed through BATWatch systems. Improper use, access, or sharing of system content may result in removal from the Provider Network.

d) No Warranty or Clinical Guarantee
BATWatch makes no warranty, express or implied, regarding the accuracy, reliability, or clinical outcomes associated with provider-facing tools or automated workflows. Your participation does not create a supervisory or employment relationship, and all clinical decisions remain your full responsibility.

2. Provider Compensation, Claims, and Credentialing Disclaimer

BATWatch offers providers the option to participate in centralized billing or to submit their own claims independently.

If you choose to have BATWatch submit claims on your behalf:

You acknowledge that claims may be delayed or denied until payer enrollment and credentialing is complete. This process can take several weeks to several months depending on the payer and region.

BATWatch will submit claims as soon as reasonably possible and will resubmit and appeal any denials on your behalf until credentialing is confirmed and reimbursement pathways are active.

BATWatch does not guarantee reimbursement from any insurance payer and is not liable for delays, non-payment, or restrictions imposed by third-party insurers.

You are responsible for responding promptly to payer credentialing requests, audits, or document submissions to ensure timely processing and eligibility.

During the pre-credentialing phase, services are billed under your NPI, and you are compensated directly by payers. Once credentialing is complete, claims transition to BATWatch group NPI workflows under your selected compensation model.

If you choose to submit claims independently:

You assume full responsibility for billing, denial management, appeals, and payment tracking.

BATWatch will supply documentation, chart exports, and visit summaries as needed, but is not liable for claim outcomes or reimbursement disputes.

Participation in the BATWatch Provider Network does not guarantee minimum earnings, referral volume, or patient availability in any region. All compensation is performance-based, volume-dependent, and subject to payer terms, policy changes, and coverage eligibility.

3. Provider Participation, Availability & Referrals

b) Telehealth Participation and Onboarding Expectations

BATWatch offers group onboarding, telehealth shadowing, and provider training opportunities to ensure a smooth integration into the BATWatch workflow. These include scheduled Zoom sessions, asynchronous learning materials, protocol walkthroughs, and shared patient education tools.

While these resources are provided at no cost:

Participation is voluntary, and BATWatch cannot compel providers to attend, complete onboarding steps, or engage in scheduled training

Missed sessions, delays in engagement, or non-responsiveness may result in limited access to referrals or removal from priority routing

b) Provider Availability & Referral Assignment
BATWatch may route patients to available providers in their licensed states based on referral load, response time, credentialing status, and historical engagement.

You acknowledge that:

• Referral volume is not guaranteed
• Referral priority may be adjusted based on participation, availability, and responsiveness
• Providers who do not actively engage in lab review, telehealth visits, or coordination efforts may be deprioritized or removed from active referral rotation

c) Independent Status and Non-Employment
Participation in the BATWatch Provider Network does not create an employment relationship. Providers are independent professionals and remain responsible for their own schedules, compliance, malpractice coverage, licensing, and participation consistency.

BATWatch provides coordination support and shared infrastructure but is not responsible for ensuring provider availability, scheduling, or communication follow-through.

d) No Liability for Missed Patient Engagement
BATWatch is not liable for patient dissatisfaction, missed care opportunities, or clinical delays resulting from a provider’s lack of availability, delayed response, or incomplete onboarding. Patients may be reassigned to alternate providers if the originally assigned provider does not engage within expected timeframes.
